    Terms of Service

    Last Updated: October 1, 2026

These Terms of Service ("Terms") govern your access to and use of the mobile applications, websites, and related services (collectively, the "Service" or "Platform") operated by EveCare Health Inc., together with its subsidiaries and affiliates, including EveCare Health India Private Limited ("EveCare," "Company," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree with these Terms, please do not access or use the Service.

    1. Eligibility

You must meet the minimum age requirements applicable to the Service in your country or region.

Unless a particular EveCare service, program, or offering expressly provides otherwise, the Service is intended for users who are at least 13 years old.

Where a service is made available to a child below the applicable age of digital consent, EveCare will use the age-verification and parental-consent processes required by applicable law before processing the child's personal information.

By using the Service, you represent that:

    • You meet the applicable age requirements
    • You are legally permitted to use the Service
    • The information you provide to EveCare is accurate to the extent reasonably necessary for the Service
    • You will comply with these Terms and applicable laws

    2. Nature of the Service and Health Disclaimer

EveCare provides digital health, wellness, educational, self-assessment, tracking, preventive and lifestyle-support tools relating to women's health.

The Service may include features such as menstrual and cycle tracking, symptom tracking, educational content, self-assessments, preventive screening-oriented tools, and Health Compass.

Important: EveCare is not a substitute for a licensed healthcare professional, medical examination, diagnosis, or treatment.

The Service is not intended to diagnose, cure, treat, or prevent a disease or medical condition unless a specific service is expressly identified as providing a regulated or clinical service and the applicable requirements for that service are satisfied.

Information, scores, assessments, risk indicators, screening prompts, educational content, predictions, and other outputs provided through the Service are intended for informational, educational, wellness, or preventive purposes and should not be relied upon as a diagnosis or as a basis for making medical decisions without appropriate professional advice.

    Health Compass

Health Compass provides preventive and screening-oriented assessments across areas including cardiovascular/heart, metabolic/diabetes, bone, breast, cognitive/brain, and pelvic health.

Health Compass may use information you provide, including demographic, lifestyle, reproductive, family-history, medical-history, and health measurements, to generate indicators, screening or risk bands where applicable, contributing factors, educational information, and preventive prompts.

Health Compass does not diagnose a medical condition, confirm that a disease is present or absent, or replace evaluation by a qualified healthcare professional.

Results may change when information or methodology is updated and should be interpreted in the context of your individual circumstances.

    Emergencies

The Service is not an emergency medical service and should not be used for emergencies or situations requiring immediate medical attention.

If you believe you are experiencing a medical emergency, contact your local emergency services or seek immediate care from an appropriate healthcare professional.

    3. Account Registration

Certain features may require you to create an account.

    You agree to:

    • Provide accurate information where reasonably required
    • Maintain the security of your account credentials
    • Take reasonable steps to prevent unauthorized access to your account
    • Notify EveCare promptly if you believe your account has been compromised

You are responsible for activity occurring through your account, except to the extent that such activity results from EveCare's failure to maintain reasonable security or from circumstances for which you are not legally responsible.

    4. User Responsibilities

    You agree not to:

    • Use the Service for unlawful, fraudulent, abusive, or harmful purposes
    • Submit information or content that you know is false, fraudulent, misleading, unlawful, or infringes another person's rights
    • Attempt to gain unauthorized access to the Service or its systems
    • Interfere with the security, integrity, availability, or performance of the Service
    • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive source code from the Service except where such restriction is prohibited by applicable law
    • Copy, reproduce, distribute, resell, lease, or commercially exploit the Service except as expressly authorized
    • Use the Service to provide professional medical advice to another person unless you are appropriately licensed and the applicable use is expressly authorized by EveCare
    • Use another person's account without authorization
    • Circumvent age-verification, parental-consent, security, access-control, or other protective measures

We may restrict, suspend, or terminate access where reasonably necessary to address violations of these Terms, security threats, fraud, legal requirements, or operational risks.

    5. Health and Personal Information

Your use of the Service may involve the submission or generation of personal, reproductive, health, wellness, location, device, and other sensitive information.

EveCare's collection, use, disclosure, retention, and protection of personal information are described in the EveCare Global Privacy Policy, which forms part of these Terms by reference.

Where consent is required by applicable law, EveCare will obtain consent through the applicable privacy notice, consent mechanism, permission flow, or other legally appropriate process.

Your use of the Service does not by itself authorize EveCare to use your health information for purposes that are not described in the Privacy Policy or otherwise permitted by applicable law.

You may have rights to access, correct, delete, withdraw consent, or otherwise control certain information as described in the Privacy Policy and applicable law.

    6. Predictions, Assessments and Educational Content

The Service may provide cycle predictions, fertility or ovulation estimates, symptom assessments, health questionnaires, screening-oriented assessments, educational content, reminders, and other informational outputs.

These outputs are based on information available to EveCare and the methodologies implemented in the Service. They may not be accurate for every individual and may change as information is added or corrected.

You should not rely solely on an output from the Service to make decisions concerning medication, contraception, pregnancy, fertility, diagnosis, treatment, or other medical care.

    7. Subscriptions, Payments and Billing

Certain features or programs may require payment or a subscription.

Pricing, subscription terms, renewal terms, cancellation procedures, and applicable taxes will be presented to you before purchase where required by law.

Payments may be processed through third-party payment providers or app-store billing systems made available through the Service.

EveCare does not intentionally store complete payment-card numbers or banking credentials in its own systems.

Payment providers may process transaction information in accordance with their own terms and privacy policies.

Unless otherwise required by applicable law or expressly stated at the time of purchase:

    • Fees are non-refundable
    • Cancellation of a subscription generally prevents future renewal but does not necessarily provide a refund for a period already purchased
    • App-store subscriptions may also be subject to the applicable Apple App Store or Google Play terms and cancellation procedures

Where applicable law or platform policy provides a refund right, that right will not be limited by these Terms.

    8. Intellectual Property

The Service and its contents, including software, designs, interfaces, text, graphics, logos, trademarks, service marks, educational materials, databases, compilations, and other content, are owned by or licensed to EveCare and are protected by applicable intellectual-property laws.

Subject to these Terms, EveCare grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

    You may not:

    • Copy or reproduce substantial portions of the Service
    • Distribute, sell, sublicense, lease, or commercially exploit the Service
    • Modify or create derivative works from the Service
    • Remove proprietary notices
    • Use EveCare's trademarks, branding, or logos without prior written permission

Nothing in these Terms transfers ownership of EveCare intellectual property to you.

    9. User-Generated Content and Feedback

The Service may allow you to submit comments, reviews, feedback, questions, journal entries, community content, or other material ("User Content") where such functionality is available.

You retain ownership of User Content that you own.

By submitting User Content, you grant EveCare a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and use that User Content only as reasonably necessary to:

    • Provide and operate the Service
    • Maintain, secure, and improve the Service
    • Respond to your requests
    • Comply with applicable law

EveCare will handle personal and health information contained in User Content in accordance with the Privacy Policy.

You represent that you have the necessary rights to submit User Content and that your submission does not violate applicable law or the rights of another person.

    10. Third-Party Services and Links

The Service may integrate with or contain links to third-party services, platforms, payment providers, identity providers, analytics services, or websites.

Third-party services may be governed by their own terms and privacy policies.

EveCare does not control third-party services and is not responsible for their independent acts, omissions, content, policies, or availability, except to the extent required by applicable law.

    11. Service Availability and Changes

EveCare may modify, update, suspend, or discontinue features or portions of the Service from time to time.

We may do so for reasons including:

    • Security
    • Legal or regulatory requirements
    • Maintenance
    • Technical changes
    • Product development
    • Changes in business operations

Where required by applicable law, we will provide notice of material changes or interruptions.

    12. Suspension and Termination

You may stop using the Service at any time.

You may request deletion of your account as described in the Privacy Policy.

EveCare may suspend or terminate access where reasonably necessary because of:

    • A material violation of these Terms
    • Fraud or abuse
    • Security risks
    • Unlawful activity
    • Legal or regulatory requirements
    • Protection of users or the Service
    • Discontinuation of the applicable Service

Where reasonably practicable and appropriate, EveCare may provide notice and an opportunity to address the issue before termination.

Termination does not affect rights or obligations that by their nature should survive termination, including intellectual-property rights, payment obligations, disclaimers, limitations of liability, indemnification, and dispute-related provisions.

    13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis.

    EveCare does not warrant that:

    • The Service will always be available, uninterrupted, or error-free
    • Information or health-related outputs will always be complete, current, or accurate
    • The Service will be suitable for every individual's circumstances
    • Predictions or assessments will produce a particular result
    • Defects will always be corrected immediately

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded or limited.

    14. Limitation of Liability

To the maximum extent permitted by applicable law, EveCare and its affiliates, officers, directors, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Service.

To the maximum extent permitted by applicable law, EveCare's aggregate liability arising from or relating to the Service will be limited to the greater of:

    • The amount you paid to EveCare for the applicable Service during the twelve months preceding the event giving rise to the claim
    • USD $100

This limitation does not apply to liability that cannot legally be limited or excluded under applicable law, including applicable liability arising from fraud, willful misconduct, or other matters for which a limitation is prohibited by law.

Nothing in these Terms limits rights or remedies that applicable consumer-protection law does not permit a business to exclude or limit.

    15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless EveCare and its officers, directors, employees, and affiliates from third-party claims, losses, liabilities, damages, and reasonable expenses arising directly from:

    • Your material violation of these Terms
    • Your unlawful use of the Service
    • Your infringement of another person's intellectual-property or other legal rights through User Content or your use of the Service

This indemnification does not apply to the extent a claim results from EveCare's own negligence, willful misconduct, or violation of applicable law.

    16. Governing Law and Disputes

For users in the United States, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except to the extent applicable mandatory consumer-protection laws provide otherwise.

For users in India, applicable Indian law will govern to the extent required by applicable law.

For users in other jurisdictions, applicable mandatory local laws and consumer protections remain unaffected by these Terms.

Any dispute will be subject to the jurisdiction of courts that have lawful jurisdiction over the dispute, subject to any mandatory consumer or other statutory rights applicable to the user.

Nothing in this section prevents a consumer from exercising rights before a regulator, government authority, consumer-protection body, or court where such rights cannot lawfully be waived.

    17. Changes to These Terms

EveCare may update these Terms from time to time.

When changes are material, EveCare will take reasonable steps to provide notice as required by applicable law.

The updated Terms will become effective on the date stated in the updated Terms.

Your continued use of the Service after the effective date may constitute acceptance of the updated Terms to the extent permitted by applicable law.

If you do not agree to material changes, you should stop using the affected Service.
